Minutes of 9/12/13 Council Meeting
The Missouri City, Missouri, City Council held their monthly open meeting at the MCCA Building on September 16, 2013, at 7:30 pm. Attending: Mayor Barry Moore, City Treasurer Lisa Webber, Water Bill Collector Brandon Gray, City Clerk Monte Railey and Council members Joe Selle, Lloyd Shockley, Rocky Gross and Schelley Sue Smith. Resident Wilbur Webber also attended.
The meeting was called to order by Mayor Moore and minutes of the 8//12/2013 meeting were read and approved
Financial reports for August were read by the Treasurer.

Councilman Shockley made motion to pay bills. It was seconded by Councilman Selle and passed 4-0.
Old Business
The 2013 City Tax Levy was set at $.8713 per $100 of assessed value.
Cold pack filling of potholes and trimming of low trees over city streets is still in progress per Joe Selle.
Rate tables for the new Water bill software are being loaded. September water bills will be done on the old program. Lisa Webber expects the new program and rates to be operational for the October billing.
Mayor Moore is following up with the Missouri department of Natural resources about questions and concerns regarding the BFI landfill north of town.
The City sign west of the MCCA Building was repainted by Joel Morgan. A search is on for the same sign that was on the east entrance to town on old 210.
Deffenbaugh Industries advised Mayor Moore of options for bulk trash day (1) $650.00 per load for house to house pick up or (2) $290.50 for per eight ton load for roll off dumpster, with $30.00 per additional ton. The Council tabled the issue until Spring of 2014.
The six week deadline given to owners of two different trailers parked on City property has passed. The Mayor will advise the Sheriff’s department to issue citations
New Business
Councilman Shockley advised the Council that, per FEMA regulations, building permits in the designated flood plain should be referred to as “Development Permits”. The Council decided to suspend issuing permits in the flood plain pending further investigation of requirements.
Councilman Gross expressed concern about water wasted when the tower is emptied for cleaning, as it was recently for yearly maintenance. The Mayor advised that he will use a work around per Operating Officer Rex Brinker for 2014.
Councilman Gross and Mayor Moore will meet with City Attorney Steven Wolcott to discuss (1) why his fees aren’t covered by court costs, (2) who to contact about tracking the flow of fine revenue from City court and (3) legal requirements for a City Sales tax.
Councilman Gross asked the Council how to respond to citizen questions/concerns about County Deputies issuing tickets per City Ordinance to unlicensed 4 wheelers and golf carts on city streets. The Mayor advised that tickets are not per City Ordinance and referred questions to the Clay County Sheriff.
The Council agreed to compensate former Treasurer Wyanda Talley for time spent assisting her with transfer of Water Bill programs. Treasurer Lisa Webber will calculate hours and report back to the Council.
Sue hart asked if the City has adopted the FEMA Flood Plain Criteria. Councilman Shockley responded that it was adopted after the 1993 flood because citizens are able to purchase flood insurance. The Council will review records to verify when plan was adopted.
Councilman Gross suggested scheduling another community softball game on October 13th at three pm. The Council agreed.
Discussion was held regarding protocol for water customers continually in arrears. The issue was tabled until the October meeting.
Councilman Shockley made a motion to close the remainder of the meeting (per Section 610.021) to discuss legal issues. The motion passed 4-0. The open session was adjourned.
A closed session was held to discuss legal issues. No votes or action was taken. Councilman Shockley made a motion to reopen the meeting. It was seconded by Councilman Gross and passed 4-0.
A motion was made by Councilman Selle to adjourn.
Meeting adjourned.
Next meeting is tentatively scheduled for 7:30 pm on Monday, October 14, 2013, at the MCCA Building.
